Homicide
Imagine
that you
are a
scientist
and You
just
created
a robot
that looks
and functions
just like
a human
being
but has
extordinary
strength
All is well
until
one day
when
because
of an internal
malfunction
the robot
goes
out
and shoots
a person
dead
who is
walking across
the street.
Question
Is this a Homicide?

I would suggest that this would be manslaughter rather than homicide or murder: The scientist did not intend to kill anyone but due to his or her carelessness and/ or irresponsibility in designing the robot as they did they would be responsible for the death.

Thanks for your response. The actual answer is no it is not. Homicide is the killing of another human being by another human being. This would include both Murder and acts of Manslaughter.
The robot is not a human therefore it cannot be homicide. Now if the Scientist had purposely programmed the robot to kill a human, then it would be.
The fact that it is a malfunction, states there was no intent. If the scientist was held liable for manslaughter then a Car manufacturer could be held to the same standard for a defect in a car that resulted in another person's death. Now the scientist could be held negligent. This was a law school question when I was in Law School. The question still intrigues me.
